In this policy, we, Atom Legal Intelligence Corporation, Inc., headquartered in Tokyo, Japan inform you about data collection of personal data and use practices relating to your use of our Callmart mobile application services.

Please make sure to read and review this policy in its entirety. Amendments made to this policy by us will be updated on this website and will be effective at the time we post it on our website. Therefore, you should review this privacy policy every time you use our service.

Definitions

The following words and terms shall have the meanings written below when they are used in the Terms and Conditions as well as the Privacy Policy.

  1. “Rainmaker”, “The Company” refers to the managing company Atom Legal Intelligence Corporation, Inc. based in Tokyo, Japan.
  2. “The App”, “The Application”, refers to the Callmart mobile application.
  3. “User(s)” means any person who uses the Callmart application, including but not limited to Buyers, Sellers, people who have registered an account with Rainmaker’s Callmart application, and the like.
  4. “Service(s)” means any function and service that Rainmaker and the Callmart application provides to Users, including but not limited to creating Callmart listings, voice communication via Callmart, Callmart transactions, and the like.
  5. “Content(s)”, “Listing(s)”, means information such as text, audio files, music, images, videos, software, programs, computer code, and the like.
  6. “Personal Information” means the information required to authenticate and distinguish the identity of each User, such as the name, phone number, email address, and the like.

Article 1: Use and collection of personal information

1.1 Personal and payment information

When you create an account on Callmart and sign up for our Service, you provide us with account registration information that you can access at any time within the Callmart app or website, including but not limited to:

  • Personal contact information, such as your name, address, phone number and email address.
  • Financial information, such as your credit card number, debit card number, and bank account.
  • Detailed personal information, such as your date of birth or tax identification number.

1.2 Use of information

We use Amazon Web Services (AWS) to store your information, such as Name and email address. We use your email address for login and authentication purposes, and also to communicate with you about your transactions (such as but not limited to Callmart earnings), new features and/or services, and other topics we believe are important to your interests.  

We use your payment information such as credit card details or other payment card information for payment processing purposes and your bank account information to transfer your earnings from the Callmart app to your designated bank account when you wish to payout your earnings. We do not store any credit card information and/or bank account information ourselves; your payment information will be processed and stored on behalf of our third party service provider, Stripe.

The third party international voice communication service provider that we use is Twilio. This is to provide Users with the function of international voice communication on the Callmart app.

When applicable and required by law, we collect detailed information from you such as your social security number or tax identification number or date of birth, and depending on the circumstances we may request you to provide us with such information. We use this detailed information, in combination with other information required depending on your circumstance, for personal identity verification and fraud prevention purposes, as well as other purposes necessary to comply with the law. We do not store any of the detailed information - detailed information will be stored on behalf of our third party service provider, Stripe.

Article 2: Type of data collected & usage

2.1 Cookies

When you use the Company’s Services such as the Company’s website and the Callmart application, we use cookies to collect certain information. ‘Cookies’ are small text files that are stored by the browser (i.e. Google Chrome, Safari, Internet Explorer) on your computer and/or mobile phone device. Cookies allow websites to store information like user preferences, so that when Users return, the website can respond appropriately. Cookies are used for the purpose of improving our services by having stored information about Users of The Application.

In cases where Users wish to deny the collection of the usage data, Users may do so by accessing their browser, device or app settings to deny the collection of cookies. Please note that by blocking and/or denying the collection of usage data, certain features and functions of our website and the App may not be able to provide services to its full ability without the use of cookies.

The Company uses “Hotjar” in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices (in particular device's IP address (captured and stored only in anonymized form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), preferred language used to display our website). Hotjar stores this information in a pseudonymized user profile. Neither Hotjar nor we will ever use this information to identify individual users or to match it with further data on an individual user. You can opt-out to the creation of a user profile, Hotjar’s storing of data about your usage of our site and Hotjar’s use of tracking cookies on other websites by following this opt-out link.

In addition, this website uses Google Analytics, a web analytics service operated by Google, Inc. 1600 Amphitheatre Parkway, Mountain View, CA 94043, (“Google”). We use the data collected by Google Analytics in order to track and monitor User information such as time, place and frequency of visits to our website, including your IP address. Google anonymizes your IP address, and therefore no personally identifiable information is collected about Users. The information generated by Google Analytics cookies about your use of this website is transmitted to Google, not The Company. The company uses this information in order to analyze visitor data in order to optimize our content to more closely match User needs.

2.2 Log data

Rainmaker may automatically record User information such as content that Users have transmitted, browsing information, timestamp, location, or other additional data that identifies the Users’ devices.

Article 3: Account information integrity

3.1

All Users are expected to provide genuine and accurate information about him/herself to the Company while using The Application, and make sure to keep his/her information up-to-date always.

3.2

The Company has the right to suspend or delete a User’s account without giving prior notice if the User is found to be violating, or has violated the Terms and Conditions.

Article 4: Security

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. However, please be aware that although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Article 5: Provision of personal information to a third party

The Company shall not disclose the personal information of Users to a third party, except in the following cases:

5.1

The Company entrusts certain works to companies which are necessary in providing the Company’s Services, the App’s Services and anything relating to the Company’s operations.

5.2

Where the Company is required to share the User’s personal information with a business partner, trusted business entity and employees.

5.3

Where the Company is required by law, legal procedures, lawsuits or governmental agencies inside or outside the country of the User’s residency, to disclose the Users’ information. In such cases, the Company has the right to disclose User information without the consent of Users.

5.4

Where it is determined by the Company that the disclosure of User information is necessary in order to protect the Users or to fulfill obligations or exercise rights under The Terms and Conditions of The Company.

5.5

Where it is permitted under the Personal Information Protection Law of Japan and other related laws and regulations, the Company may disclose information of Users to comply with the law accordingly.

Article 6: Protection of personal information

6.1

The Company promises to protect personal information of Users with the utmost care, and the Company takes well advised administrative measures including both technical and physical means in order to prevent loss, theft, misuse, unauthorized access, and the likes of the personal information of Users.

6.2

The Company shall take all necessary precautions and measures to restrict and monitor the Company’s employees’ access to such personal information, and shall oblige all employees to comply with all confidential agreements executed and valid between the Company and its employees. However, as the Company cannot guarantee complete safety and protection of the Users’ personal information, the Users must agree that the personal information provided is at the Users’ own risk.

6.3

Users that do not agree shall not use any of the Company’s Services, the App, and/or anything concerning the Company’s operations.

Article 7: Procedure of disclosure, correction, suspension, etc. of personal information

7.1

Users have the right to, at any time, to confirm and correct changes to their registered personal information such as email address and debit card/credit card payment information.

7.2

Users shall be aware and consent that some confidential information, such as but not limited to registered bank account details and Callmart ID, cannot be modified after the the initial account registration. In cases where Users wish to modify confidential information stated in the preceding sentence, Users shall contact the Company by sending an email to info@rainmakers.co.jp, or by accessing the the App’s Contact Us page.

7.3

Users have the right to delete their accounts, so long as they abide by the procedures set forth by The Company.

Article 8: Disclaimer

Users shall agree to have full responsibility for information and content shared voluntarily by the Users on the Callmart application. The Company shall not be liable for the damage incurred by the Users and third parties.

Article 9: Service of a third party

The Services provided by the Company may provide a link/URL to services managed by a third party. Information to be collected by a third party shall be managed under the privacy policy of the third party. Therefore, in addition to the Company’s Terms and Privacy Policy, the Company recommends Users to read the third party’s private policy in its entirety as well. Rainmaker shall not be responsible for any service other than the Company’s Services and The Application’s services.

Article 10: Opt-out rights

You can stop all collection of information by the Application by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network. You can also request to opt-out via email, at info@rainmakers.co.jp, or by sending us a direct request through the Contact Us page on our website.

Article 11: Policy towards children

Rainmaker’s Callmart application is not directed to children under 13 years of age. We do not knowingly collect personally identifiable information from children under 13, and furthermore, if we do become aware that a child under 13 has used our Callmart application and Services, we will immediately delete such information from our files.

Article 12: Your consent

By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. "Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in Japan. If you reside outside Japan, your information will be transferred, processed and stored there under Japan’s privacy standards.
